2010: Can Texas Democrats Dream Again?

With the filing deadline having passed quietly on Tuesday—quietly, that is, unless you're the sickest kind of political addict—there's cheerful news for Texas Democrats as they look to the 2010 statewide elections. Which is a strange thing to find myself typing, given their grim track record over the last couple of decades. Strange—but true. And surprising in equal measure.

The dominant Republicans, of course, have long known what to expect on their side: A potentially divisive battle at the top of the ticket between Sen. Kay Bailey "Will I, Won't I?" Hutchison and Gov. Rick "States' Rights" Perry. Otherwise, precious little drama in their statewide primaries—and only token opposition in the statewide races where they've batted 1,000 since 1998.

Just two months ago, Democrats hadn't the slightest clue about what to expect—aside from yet another year of near-certain futility. After all but one of the state's potentially viable Dems had wussed out of the governor's race, the party's likeliest ticket-topper was Fort Worth businessman and George W. Bush pal Tom Schieffer, who could have raised more money and garnered more enthusiasm in his 10-month exploratory campaign by stationing himself at a busy intersection with a cardboard sign reading: "I'm a Democrat—really! Please help!" Nobody of note was stepping up to challenge Lt. Gov. David Dewhurst. And it was the same on down the line, statewide race after statewide race: It looked for all the world like the Republicans were going to sail to another sweep, getting to focus their money and energies on salvaging their slim majority in the state House.

But lo, unto the Dems a savior appeared: wildly popular Houston Mayor Bill White, who switched from gunning for Hutchison's fictionally available Senate seat and gave his party a reason for optimism that's anything but fictional. And over the next six weeks, the Democratic blanks began to be filled in down the ballot (with the one inexplicable exception of the race for the powerful Comptroller's office, where party officials couldn't find a single soul willing to challenge the less-than-invincible incumbent, Susan Combs).

Maybe the best news for Texas Democrats—aside from White's blessed reversal—is that they'll actually have party primaries that might create a few fireworks and stir some interest without tearing the party apart. The party's top statewide vote-getter from 2006, East Texas rancher Hank Gilbert, will face off against Kinky Friedman, who dropped his inexplicable run for governor to try for (Inexplicable Part II) Agriculture Commissioner. The winner could have an outside shot at knocking off the Republican functionary now running Ag, Todd Staples.

The Lite Gov primary will offer less sideshow entertainment than Gilbert vs. Friedman. But for Democrats—and potentially, for any Texan interested in good and honest government—it offers far more consequential stakes. Former Travis County District Attorney Ronnie Earle, a white-hatted hero to many progressives for prosecuting Tom Delay, Sen. Hutchison and even himself, threw his hat in the ring. And then Linda Chavez- Thompson—sharecropper's daughter, national labor leader and vice chair of the Democratic National Committee—followed suit, potentially giving Democrats a boost in Latino turnout.

(A momentary digression into obligatory fairness: Austin deli mogul Marc Katz is also running for the Dems' Lite Gov nomination and swearing he'll spend gobs of cash. Ditto Houston hair-care mogul Farouk Shami, who's running against White for the gubernatorial nod. Nobody but Katz and Shami quite knows why.)

Compared with what the Dems very recently had every right to expect—no, fear—it's almost too good to be believed. Not since the ill-named "Dream Team" (John Sharp for Senate, Tony Sanchez for governor, Ron Kirk for lieutenant governor) raised—and then dashed—Democratic hopes in 2002 has the party faithful enjoyed such a season of hope. How hopeful do things look? Look no further than this: Even The Dallas Morning News has been moved to recognize the outside chance that White, at least, could break the Republicans' long winning streak.

In part, the relative strength of the Democrats' statewide ticket for 2010 is a reflection of the undeniable fact that the Republican hold on Texas is slowly eroding. The eye-popping turnout for the 2008 Obama-Clinton shindig was just one sign of that. The Democrats' near-miss in retaking the state House later that year was another. The Democrats now rule Dallas , dominate Houston [and El Paso ], and continue to reap the benefits of the Republicans' tone-deaf immigrant-bashing in winning the loyalties of Latinos.

Harvey Kronberg, editor and publisher of Quorum Report, says that the Republicans' demographic "structural advantage" has already shrunk from its apex of 1.5 million statewide to about a half-million—an edge that White, especially, is well-situated to overcome with his strong base in Harris County and its environs. In that vast metro stretch with about one-third of the state's total votes, Gov. Perry's been unusually popular, Kronberg notes. He would normally expect to roll up a huge and probably decisive margin there—against any Democrat but White.

Another of the state's most astute political observers, SMU's Cal Jillson, is quick to note—accurately enough—that it remains true until proven otherwise that "you could lose a lot of money betting on Texas Democrats." Anybody foolish enough to bet on the Dream Team debacle of 2002 certainly lost a mint.

Aside from the Republicans' persistent—though waning—edge in voter loyalty, the Democrats' biggest enemy in 2010 could be their own, perfectly understandable, lack of faith. How many times can you work up your hopes, have them mercilessly crushed, and keep coming back for more?

"In the last half-dozen cycles, Texas Democrats were so beaten down that they sort of went to ground," Jillson says. "They didn't have really good candidates, didn't put money behind them, so you got late into each race and Democrats would see their candidates a dozen points behind. They've never really had the horses to bet on. In this race, they do have that in Bill White."

Will they make the bet? Democrats were turning cartwheels when White announced, and they're still dizzy with unfamiliar excitement. But the test, Jillson says, is "whether they will see White and others on the ticket and get behind them. Will they put some money in, so national Democrats can see that commitment and add to the pot?" And will they have the juice in their ground game to counter the Republicans' organizational edge in voter turnout? "If that happens," Jillson says, "we could have an interesting race."

By God, we could.

The President: Hello everyone – how’s everybody doing today? I’m here with students at Wakefield High School in Arlington , Virginia . And we’ve got students tuning in from all across America , kindergarten through twelfth grade. I’m glad you all could join us today.

I know that for many of you, today is the first day of school. And for those of you in kindergarten, or starting middle or high school, it’s your first day in a new school, so it’s understandable if you’re a little nervous. I imagine there are some seniors out there who are feeling pretty good right now, with just one more year to go. And no matter what grade you’re in, some of you are probably wishing it were still summer, and you could’ve stayed in bed just a little longer this morning.

I know that feeling. When I was young, my family lived in Indonesia for a few years, and my mother didn’t have the money to send me where all the American kids went to school. So she decided to teach me extra lessons herself, Monday through Friday – at 4:30 in the morning.

Now I wasn’t too happy about getting up that early. A lot of times, I’d fall asleep right there at the kitchen table. But whenever I’d complain, my mother would just give me one of those looks and say, "This is no picnic for me either, buster."

So I know some of you are still adjusting to being back at school. But I’m here today because I have something important to discuss with you. I’m here because I want to talk with you about your education and what’s expected of all of you in this new school year.

Now I’ve given a lot of speeches about education. And I’ve talked a lot about responsibility.

I’ve talked about your teachers’ responsibility for inspiring you, and pushing you to learn.

I’ve talked about your parents’ responsibility for making sure you stay on track, and get your homework done, and don’t spend every waking hour in front of the TV or with that Xbox.

I’ve talked a lot about your government’s responsibility for setting high standards, supporting teachers and principals, and turning around schools that aren’t working where students aren’t getting the opportunities they deserve.

But at the end of the day, we can have the most dedicated teachers, the most supportive parents, and the best schools in the world – and none of it will matter unless all of you fulfill your responsibilities. Unless you show up to those schools; pay attention to those teachers; listen to your parents, grandparents and other adults; and put in the hard work it takes to succeed.

And that’s what I want to focus on today: the responsibility each of you has for your education. I want to start with the responsibility you have to yourself.

At the beginning of August, President Obama wrote to the OFA community to challenge us to work hard, break through the noise and give the American people a voice in the fight for health insurance reform.

It wasn't easy: With Congress back home, special interests and partisan attack groups went into overdrive spreading lies, and the media seemed to broadcast any story of conflict or division they could find.

But you accepted the President's challenge -- and delivered.

Our strategy for the month was simple: engage the millions of individuals who know we need change to fight the lies and tell the truth, build support for reform, and ensure that support is highly visible while members of Congress are home gauging public opinion. We continued our methodical, battle-tested approach of volunteers reaching out online and offline in every part of the country. We offered the facts, answered questions and engaged those who were ready to get involved.

And the results were extraordinary. OFA supporters like you came together in an unprecedented way over the past four weeks -- and it couldn't have happened without the individual volunteers who make it all possible:
  • Folks like Rebecca E. in Santa Fe, New Mexico, who voted for the first time last year -- and collected more than 1,800 health care declarations this summer. Across the country, we've collected more than 1 million signatures in support of the President's core principles for health insurance reform.
  • Supporters like Nita L. in Longmont, Colorado, who organized hundreds of supporters in her town to come with her to talk with their member of Congress about how much this fight means to them. They were among the more than 70,000 folks who showed up at 350 town halls -- where supporters of reform at times outnumbered opponents by 10-1 -- and volunteers who made 65,000 trips to local congressional offices.
  • It's the people who made more than 100,000 calls to Congress to thank representatives fighting for change -- like Nancy T. in Hendersonville, North Carolina, who hosted a health care phone booth because, after her heart transplant, she knows that no American should have to choose between financial ruin and getting the care they need.
  • It's the 1,500 supporters who filled a local recreation center in Kansas City, Missouri, at a town hall meeting with Senator Claire McCaskill, and the 2,500 people who jammed the streets to hear from Senator Sherrod Brown in Ohio -- just two of the more than 4,000 events where folks gathered to show their support across all 50 states in August.
All of these signatures, calls, office drop-bys, conversations, gatherings, and town hall meetings, all of the late nights, homemade signs, long hours in the sun, and tireless volunteers who make it happen -- totaling more than 1.5 million people who've taken part in this campaign for real reform -- it all adds up to one incredible movement for change.

As Congress returns to D.C. and we roll up our sleeves for the final push toward reform, we know the hardest work may yet lie ahead. The special interests and those in Congress who have pledged to oppose the President no matter what will stoop even lower in the weeks ahead.

But you should never doubt that we face the coming challenges together, as part of something far larger than any of us alone -- and far stronger than the old broken politics that have preserved the status quo for long enough.

Our strategy is working. We are going to win this thing. Americans will finally get the health insurance reform we all need.

Congress is about to head back to D.C. to make historic decisions about health insurance reform. This is our last, best chance to take a stand while their attention is focused back home. So we're organizing "Health Insurance Reform Now" events all around the country to show the overwhelming support for reform.

These events will be watched closely by Congress and the media to gauge just how strongly voters feel about reform -- and every extra person who shows up will make a strong, public case for change.

*Ten Questions Tea Baggers Don't Dare Ask*

As nearly everyone now knows, United Health, the nation's top health
insurance company hired Dick Armey, the man behind Freedomworks, to
launch his army of town hall protesters. Armey, the former Republican
House majority leader, more recently a lobbyist at DLA Piper, netted
millions from health insurance companies to disrupt town hall meetings
during Congress' August recess.

Why? Here's why-to protect one of the most profitable businesses in
America today. Basically, health insurance companies make money by
kicking people out of health care. Did you about the woman who was
kicked off for having acne 20 years ago?

A few days before Texan Robin Beaton was scheduled to have a double
mastectomy, her insurance company told her that they were putting her
coverage on hold for three months. After finding a minor discrepancy
related to a doctor's visit for acne, Beaton's insurer canceled her
policy. Beaton was without health coverage and delayed treatment for
five months, during which time the tumor tripled in size. Eventually,
because her Congressman intervened on her behalf, her health coverage
was reinstated.

So, when September 2^nd rolls around, and Tea Baggers collect here in El
Paso, here are ten questions Tea Baggers won't dare ask.

*1.** Who pays for your daily emails and talking points? *

Lobbyist-run groups, like FreedomWorks, which orchestrated the tea
parties earlier this year, are now pursuing an aggressive strategy to
create an image of mass public opposition. A leaked memo from Bob
MacGuffie, a volunteer with the FreedomWorks web site Tea Party
Patriots, details how members should be infiltrating town halls and
harassing Democratic members of Congress. Here are some excerpts:

    * *Artificially Inflate Your Numbers:* "Spread out in the hall and
      try to be in the front half. The objective is to put the Rep on
      the defensive with your questions and follow-up. The Rep should be
      made to feel that a majority, and if not, a significant portion of
      at least the audience, opposes the socialist agenda of Washington."

    * *Be Disruptive Early And Often:* "You need to rock-the-boat early
      in the Rep's presentation. Watch for an opportunity to yell out
      and challenge the Rep's statements early."

    * *Try To "Rattle Him," Not Have An Intelligent Debate:* "The goal
      is to rattle him, get him off his prepared script and agenda. If
      he says something outrageous, stand up and shout out and sit right
      back down. Look for these opportunities before he even takes
      questions."

The memo above is similar to the talking points being distributed by
FreedomWorks for pushing an anti-health reform assault all summer.
*Patients United*, a front group maintained by *Americans for
Prosperity*, is actively busing people all over the country for more of
these staged protests. Representatives of the health insurance industry
have also been sending employees to "monitor" town halls across the country.

*2.** What percent of each health care dollar does United or Blue Cross
take? *

Today in the U.S., private insurers spend up to 29% of all claims paid
on administrative costs, which include denial management. In contrast,
the administrative costs for Medicare and Medicaid are 3 to 5%.

*3.** What is the 37^th most expensive hospital in America? *

Tenet Healthcare Corporation-owned Sierra Medical Center in El Paso.

* 4.** What is the 46^th most expensive? *

Providence Memorial Hospital, another hospital owned by Tenet Healthcare
Corporation.

* 5.** What has happened to health insurance premiums in Texas over the
last ten years?*

Nationally, premiums for employer-provided plans have risen four times
faster than wages and are now double their cost nine years ago. In
Texas, premiums have risen 104% since 2000-ten times faster than Texans'
wages increased. Rates are projected to increase another 7.3 percent in
2009.

* 6.** What's a rescission bounty hunter?*

A rescission "bounty hunter" is an insurance employee who is paid to
pore over your original insurance application and all of your medical
and pharmacy records for ANY discrepancy so that the insurer to can
rescind or cancel your policy. This usually happens after you're
diagnosed with an illness and actually using your benefits.

A prime example of rescission is Robin Beaton whose insurer rescinded
her policy after she was diagnosed with breast cancer. The basis for
rescinding her policy? She didn't report seeing a doctor for acne
several years prior to her breast cancer diagnosis. By the way, there's
no medical link between acne and breast cancer; the insurance company
was just looking for any reason to rescind her policy so that they would
not have to pay for the treatment of her breast cancer.

A Congressional investigation by the House Committee on Energy and
Commerce earlier this summer found that Blue Cross of California
encouraged employees through performance evaluations to cancel the
health insurance policies of individuals with expensive illnesses. Blue
Cross employees who rescinded literally thousands of policies and saved
the insurer almost $10 million in claims received "perfect" scores for
"exceptional performance" on their evaluations.

The investigation revealed that WellPoint's Blue Cross of California
subsidiary and two other insurers saved more than $300 million in claims
by rescinding the policies of more than 20,000 sick policyholders over a
five-year period.

*7.** Why did Tenet get fined $900 million?*

In June 2006, the Department of Justice reached a settlement with Tenet
Healthcare Corporation -- owners of Sierra and Sierra-Providence
Hospitals in El Paso -- to pay the U.S. more than $900 million to
resolve False Claims Act allegations related to Medicare fraud. Of the
$900 million settlement amount, the agreement requires Tenet to pay:

    * more than $788 million to resolve claims arising from Tenet's
      receipt of excessive "outlier" payments (payments that are
      intended to be limited to situations involving extraordinarily
      costly episodes of care) resulting from the hospitals inflating
      their charges substantially in excess of any increase in the costs
      associated with patient care and billing for services and supplies
      not provided to patients;

    * more than $47 million to resolve claims that Tenet paid kickbacks
      to physicians to get Medicare patients referred to its facilities,
      and that Tenet billed Medicare for services that were ordered or
      referred by physicians with whom Tenet had an improper financial
      relationship; and,

    * more than $46 million to resolve claims that Tenet engaged in
      "upcoding," which refers to situations where diagnosis codes that
      Tenet is unable to support or that were otherwise improper were
      assigned to patient records in order to increase reimbursement to
      Tenet hospitals.

*8.** Which hospitals in El Paso charge the most?*

Even though the Texas-Mexico border is one of the poorest areas in the
U.S., it is home to some of the most expensive hospitals in the country.
In fiscal year 2003-2004, Brownsville Medical Center was #8, Sierra
Medical Center was #37, and Providence Memorial Hospital was #46. These
three Tenet-owned hospitals are the most expensive hospitals in Texas.
The national average total charge to cost ratio for the 4,222 hospitals
studied was 244.37%. In striking contrast, Brownsville Medical Center's,
Sierra Medical Center's and Providence Memorial Hospital's total charges
as a percent of total costs were 813.57%,* *697.73%, and 675.49%,
respectively-about three times the national average.

*9.** Which hospital spent hundreds of thousands of dollars trying to
kill the Children's Hospital at University Medical Center?*

Tenet spent hundreds of thousands of dollars trying to kill our new
Children's Hospital, another "public option." Upon review of reported
political contributions and expenditures, Tenet spent at least
$285,194.21 to oppose the Children's Hospital Bond in 2007-this figure
does not include the thousands of dollars Tenet spent to advertise their
children's wing as "The Children's Hospital at Providence."

*10.** How much do premiums rise because the uninsured are not covered? *

Texas businesses and families shoulder a hidden health tax of roughly
$1,800 per year on premiums as a direct result of subsidizing the costs
of the uninsured.

*'Fess up-How many Tea Baggers out there are on or have family on
"government programs" like Medicare and TRICARE and have called the
President's plan "socialized medicine?"*
